Florida Attorney General Files Lawsuit Against Netflix Over Children's Privacy


Florida Attorney General James Uthmeier has officially launched a high-profile lawsuit against streaming giant Netflix, accusing the company of conducting a long-term bait-and-switch strategy that compromises the privacy of children and families. The sixty-six-page legal complaint alleges that Netflix misled subscribers into believing that paying a recurring monthly subscription fee would shield them from Big Tech surveillance and target-driven advertising. Instead, state officials argue that Netflix built a massive internal data-tracking apparatus while secretly harvesting user activity to power its expanded commercial advertising operations.

The lawsuit centers heavily on how Netflix handles data connected to children and minor users. State prosecutors contend that parents choose paid streaming platforms specifically to create a safe, ad-free environment for their children. However, the state claims Netflix actively monitored every user action, including clicks, searches, swipes, and viewing duration, without providing transparent notice or obtaining appropriate legal consent from parents. The state further alleges that Netflix designed platform features to encourage binge-watching habits, keeping young viewers engaged on the service for longer periods to gather detailed behavioral insights.

According to state officials, the collected data was opened up to commercial data brokers and external advertising partners following the launch of Netflix's ad-supported subscription tiers. The lawsuit asserts that advertisers were granted access to data tools that enabled them to target Florida households based on specific life stages, income levels, and household compositions. State leadership emphasized that parents, rather than corporate executives, hold the ultimate authority in directing the upbringing and digital exposure of their children, making transparency and compliance mandatory under Florida state law.

The state of Florida is seeking billions of dollars in civil penalties and financial damages. In addition to monetary restitution, the legal filing demands a court order forcing Netflix to purge all user data deceptively gathered from Florida residents and permanently discontinue platform features designed to promote compulsive viewing behaviors among minors. Attorney General Uthmeier stated that the lawsuit sends a firm message to major technology companies that deceptive practices involving children will lead to serious legal consequences and heavy financial accountability.

In response to the legal action, a representative for Netflix released a statement strongly rejecting the claims. The company stated that it takes member privacy very seriously and strictly abides by global data protection legislation everywhere it operates. Netflix highlighted its existing specialized safeguards for children's profiles, including parental controls that permit families to block specific content or restrict viewing options. The company maintained that the lawsuit completely lacks merit and confirmed its intention to defend its business practices vigorously in court.

This lawsuit forms part of a wider trend of increased scrutiny directed toward major entertainment and technology corporations regarding child safety, platform design, and digital surveillance. Similar legal actions have been initiated by state regulators across the United States, targeting platforms that collect user data without explicit authorization or utilize engagement-focused algorithms on young audiences.
